The reason Berkey filters are currently unavailable stems from an unexpected and unprecedented action by EPA Region 8, which classified Berkey water filtration systems as a "pesticide".

In response, Berkey International and the James Shepard Trust filed a lawsuit against the EPA, challenging this ruling.

The case, officially known as Case 3:24-cv-01106-CVR, is still active and currently being fought in Puerto Rico.

Additionally, Berkey has filed an appeal to overturn the decision.

The lawsuit specifically targets former EPA officials from Region 8 as well as the former head of the EPA.

Interestingly, since the new administration took office, many of these individuals are no longer employed at the agency.

However, it remains unclear why the new leadership has yet to reverse this decision and allow Berkey filters back on the market.

For now, consumers are left waiting for legal proceedings to unfold.

They are hoping for a resolution that will bring Berkey filters back in stock.

The Clown Show That Designated Berkey Filters a Pesticide

What Is the Current Status of the Berkey Lawsuit?

The legal battle over Berkey filters is still ongoing, with the most recent case—USCA Case Number 24-1917—currently open and being pursued by Berkey International LLC.

Previously, the U.S. Supreme Court declined to hear a separate case (Shepherd et al. v. Regan et al., No. 24-531) regarding the EPA's decision to classify Berkey filters as requiring a pesticide label under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).

On December 16, 2024, the Supreme Court denied certiorari, leaving in place a lower court ruling that the James B. Shepherd Trust and New Millennium Concepts Ltd. lacked standing to challenge the EPA's actions.

How Did This Legal Battle Begin?

The dispute started in 2023 when the EPA issued a stop sale order (SSURO).

This preventedx Berkey International from manufacturing filters containing antimicrobial silver—despite the product being on the market for over 25 years without issue.

The agency also blocked certain distributors from selling the filters under the same ruling.

In response, New Millennium Concepts Ltd. and the James B. Shepherd Trust filed a lawsuit in the U.S. District Court for the Northern District of Texas, arguing that the EPA had overstepped its authority under FIFRA and violated the Administrative Procedure Act (APA).

However, U.S. District Judge Mark T. Pittman dismissed the case, ruling that the plaintiffs lacked Article III standing because they did not directly receive an SSURO.

He criticized the plaintiffs for failing to include Berkey International LLC.

They are the actual manufacturer impacted by the ban—as a party in the case.

What Happened Next?

The 5th Circuit Court of Appeals upheld the dismissal without further discussion.

The plaintiffs then petitioned the U.S. Supreme Court for review, arguing that the EPA's actions caused direct economic harm, including lost royalties and increased compliance costs.

The Supreme Court denied the petition on December 16, 2024, effectively ending that particular legal challenge.

What's Next for Berkey?

While this Supreme Court case is closed, Berkey International LLC is still actively fighting the EPA in USCA Case Number 24-1917, keeping hopes alive for a reversal of the regulatory decision.

For now, the future of Berkey filters remains uncertain, as the new EPA administration has yet to address or overturn the previous ruling.
